Terms of Service

1. Agreement to Terms

By accessing or using AIsance ("the Service"), operated by Yannick Hofmeister ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AIsance provides an AI-powered fluency assessment that evaluates your ability to work with artificial intelligence through a conversational format. The Service scores your responses across five domains and generates a personalized improvement roadmap. The assessment is facilitated and graded by AI (Anthropic Claude).

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Credits and Payments

Assessments require credits, which are purchased through our payment processor, Stripe. Credits are deducted at the start of each assessment. All purchases are final and non-refundable, except where required by applicable law or in cases where a technical failure prevents an assessment from completing. Prices are listed in the currency shown at checkout and may change at any time without prior notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or extract the assessment methodology or scoring rubrics
• Share, resell, or transfer your account or credits to third parties without authorization
• Submit deliberately false, misleading, or automated responses to manipulate scores
• Interfere with or disrupt the Service or its underlying infrastructure

6. Intellectual Property

All content, design, scoring methodology, and software comprising the Service are the property of Yannick Hofmeister and are protected by applicable intellectual property laws. Your assessment responses remain your own; however, by using the Service, you grant us a limited license to process your responses for scoring and to generate your results.

7. AI-Generated Content

Assessment results, scores, roadmaps, and recommendations are generated by artificial intelligence and are provided for informational purposes only. They do not constitute professional advice. While we strive for accuracy, AI outputs may contain errors or reflect biases inherent in the underlying models. You should exercise your own judgment when acting on any recommendations.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities. Our total liability shall not exceed the amount you paid for the specific assessment giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive termination (including limitations of liability and intellectual property rights) will remain in effect.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the email address associated with your account or by a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
